In Virginia, the manufacturer and/or distributor of a defective or unreasonably dangerous product may be held civilly liable when their product injures or kills the product’s user. Such cases are known as product liability claims. According to the Consumer Products Safety Commission of the United States Government, unreasonable risks of serious injuries and death may be arise in connection with a number of common household products and/or activities, including bicycles, cribs, defective hip impants, Chinese Drywall, products containing lead, playgrounds, certain toys, and amusement park rides. Some defective products enter the stream of commerce without having their dangerous conditions or defects known by the public. When that happens, serious injuries may follow.
There are three general types of product liability claims in Virginia: design defects, manufacturing defects, or a breach of the duty to instruct or warn a consumer of a product’s dangerous condition. All three claims require proof that a product left the manufacturing process with a defective condition, that the product was in that same condition when the malfunction of that product occurred, and that the product was being used in its intended manner when the malfunction occurred. These claims involve a complicated technical and legal analysis involving the equipment that malfunctioned, the mechanism of the malfunction, and the cause of the injuries. On account of the high stakes of the proceedings, product liability cases are often hard fought legal battles against a well-funded and aggressive adversary.
