Workplace Injuries
In Virginia, employees injured in their place of work are generally barred from seeking any monetary recovery from their employer other than payment of workers’ compensation benefits. When the workplace injury is caused by a party other than the employer, however, the injured worker may have a claim against the negligent third party.
Compensable workplace injuries may arise from the negligent or intentional acts of a third party in the following situations:
- Dangerous and defective equipment or tools
- Exposure to unreasonably dangerous chemicals
- Exposure to unreasonably dangerous airborne particles, such as asbestos
- Inhalation of manganese fumes by welders
- Exposure to dangerous drugs for healthcare workers
- Assault, battery, and harassment by customers, or in some cases co-workers, or supervisors
